Terms of Use

These Terms of Use are a binding agreement between you and Zbroz Technology Solutions, LLC (“we,” “us,” “our”) for The Deaf Socials (the “Service”). By creating an account, tapping Continue on Create account, or using the Service, you agree to these Terms, the Privacy Policy, the Cookies & similar technologies page, and the AI & Data page. If you do not agree, do not create an account or use the Service.

1The agreement

These Terms apply to the mobile app, our legal pages, the password-reset page, and related services we provide for The Deaf Socials.

Please read the Privacy Policy, Cookies & similar technologies, and AI & Data pages. They are part of this agreement.

If you use the app from an Apple or Google store, those stores’ rules also apply. If those rules conflict with these Terms for that store’s required topics, the store’s required terms control for that conflict only. Everything else in these Terms still applies.

2Who may use the Service

You must be at least 13 years old. We do not knowingly collect information from children under 13. If you are 13–17, a parent or guardian should review these Terms with you and is responsible for your use.

You must be able to form a contract. You may not use the Service if we have suspended or closed your account, or if the law forbids you from using it.

You are responsible for your account, your password, your device, and everything done with your account. Tell us at privacy@thedeafsocials.com if you think someone else is using it. Log out on devices you do not control.

3The license we give you

We give you a limited, personal, revocable, non-exclusive, non-transferable license to use the Service as we provide it, only for its intended purpose: discovering and sharing community events.

You may not, and you may not help anyone else:

  • Copy, scrape, crawl, harvest, or bulk-download the Service or other people’s content except as a normal user of the app.
  • Reverse engineer, decompile, or try to extract source code except where the law says you may.
  • Overload, probe, or interfere with the Service, including bypassing rate limits or security.
  • Use another person’s account, impersonate anyone, or misstate who you are.
  • Send malware, spam, or automated traffic that is not a normal use of the official app.
  • Use the Service to harm people, to break the law, or to list events that are illegal or dangerous.
  • Remove or hide our names, marks, or notices.

The Deaf Socials, its name, logos, design, software, and documentation belong to Zbroz Technology Solutions, LLC and its licensors. These Terms do not sell you those rights. Feedback you send us may be used freely, without paying you, and you assign to us any rights in that feedback that the law allows.

4Your content (events, going, and related data)

You keep ownership of the event details and other content you submit. You grant Zbroz Technology Solutions, LLC a worldwide, perpetual, irrevocable, royalty-free, sublicensable, transferable license to host, store, copy, display, distribute, modify (for formatting), and otherwise use that content to operate, protect, improve, and promote the Service — including titles, descriptions, times, addresses, map pins, social links, going status, and snapshots in event history.

You promise that:

  • You have the right to post the content and to grant this license.
  • The content is accurate enough for people to understand the event.
  • The content is lawful and does not violate other people’s rights (including privacy, publicity, and copyright).
  • Social links you add are yours to share and go only to Facebook, Instagram, or Eventbrite as the app requires.

We may refuse, hide, unpublish, reject, or remove content, and we may suspend or close accounts, at any time, with or without notice, when we believe it is needed for safety, law, these Terms, or the health of the community. We do not have to monitor every post. If we do not act, that is not a waiver of our right to act later.

New events start as pending and stay off the public map and list until an operator approves them. Published edits may stay off the public map until approved. We may reject a create or an update and keep a reason. We do not promise that any event will be approved or will appear on the map.

5Community events — you attend at your own risk

The Deaf Socials is a directory and a set of tools. Unless we clearly say otherwise in a signed writing from Zbroz Technology Solutions, LLC, we do not create, host, staff, supervise, secure, insure, or police gatherings listed in the app. We are not the venue, the organizer, a security company, or law enforcement.

You attend events at your own risk. You are solely responsible for deciding whether to go, stay, or leave.

  • We do not screen organizers or attendees. We do not run background checks, identity checks, or criminal-history checks. A username, going count, or “I’m going” tap is not a verification of anyone.
  • We do not verify venues, owners, permits, occupancy, fire safety, lighting, cameras, door staff, or neighborhood safety.
  • Approving an event so it can appear on the map is not a safety rating, a background check, or a promise that the gathering is lawful or safe.
  • Organizers are solely responsible for their events, including who they invite, safety, permissions, age limits, and what they tell attendees.
  • Attendees are solely responsible for their own conduct and safety, including travel to and from the place.
  • Map pins depend on the place the organizer confirmed. Pins can be wrong. Always use your own judgment.
  • The Service is not an emergency, medical, rescue, or accessibility-guarantee service. If you are in danger, contact local emergency services (in the U.S., call 911).

No responsibility for crime or harm. To the fullest extent allowed by law, Zbroz Technology Solutions, LLC and its people, contractors, and partners are not responsible and not liable for anything that happens at, near, on the way to, on the way from, or because of any event listed in the Service — including, without limitation: assault; sexual assault or abuse; homicide; shooting or other use of a firearm or weapon; robbery; kidnapping; stalking; harassment; hate crimes; human trafficking or sex trafficking; prostitution or other commercial sexual activity; drug manufacture, sale, possession, or use; intoxication; driving under the influence after an event; property damage; theft; fraud; cancellation; injury; death; or any other crime, accident, or harmful act by any organizer, attendee, bystander, or third party. We do not control those people. Their acts are their own.

If a crime or emergency is happening or has happened, contact law enforcement right away. Telling us in the app is not a substitute for calling the police. We may remove listings and cooperate with law enforcement as described in the Privacy Policy, but we have no duty to monitor events in real time and no duty to prevent crime.

6Maps and other companies’ services

Map tiles come from OpenStreetMap. Place links may involve Google Maps or Apple Maps. Optional event links may open Facebook, Instagram, or Eventbrite. Password-reset email may be sent by Resend. Hosting and database may be provided by Heroku and similar providers.

Those companies have their own terms and privacy rules. We are not responsible for their services, outages, or content. If you leave our app to open a link, you do so at your own risk.

7Acceptable use

You agree you will not use the Service to:

  • Post hate, harassment, threats, or sexual content involving minors.
  • List or promote events for illegal activity, including drug sales, weapons crimes, violence, sexual exploitation, human trafficking, or sex trafficking.
  • Use the Service to recruit, advertise, or arrange any crime.
  • Post scams, fake events, or listings meant to collect other people’s information.
  • Doxx, stalk, or reveal another person’s private information.
  • Interfere with event review, fake going counts, or manipulate discovery.
  • Use the Service if your account is disabled.

If you see a listing that looks illegal or dangerous, do not attend. Contact law enforcement if there is a threat of harm, and email privacy@thedeafsocials.com so we can review the listing. We may remove content and suspend accounts. We may also share information with law enforcement as described in the Privacy Policy. Acting — or not acting — does not make us the organizer or make us responsible for what happens at an event.

8Fees

The Service is currently free. We may add paid features later. If we do, we will explain the price before you pay. These Terms still apply. Store purchases follow Apple or Google payment rules.

9No warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT ALLOWED BY LAW, ZBROZ TECHNOLOGY SOLUTIONS, LLC AND ITS PEOPLE, LICENSORS, AND PROVIDERS DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, AND NON-INFRINGEMENT.

We do not promise that the Service will be uninterrupted, timely, secure, or error-free; that events are accurate, lawful, or safe; that maps or pins are exact; that people you meet are who they say they are; that content will be stored or backed up; or that defects will be corrected. You use the Service at your own risk.

10Limit of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, ZBROZ TECHNOLOGY SOLUTIONS, LLC AND ITS PEOPLE, LICENSORS, AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST GOODWILL, OR BUSINESS INTERRUPTION, EVEN IF ADVISED THAT THEY WERE POSSIBLE.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) ONE HUNDRED US DOLLARS (USD $100) OR (B) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM. Today you pay us nothing to use the app, so that amount is $100 unless a law that cannot be waived says otherwise.

These limits include claims about events, other users, crime, or harm at gatherings. TO THE FULLEST EXTENT ALLOWED BY LAW, WE ARE NOT LIABLE FOR THE CRIMINAL OR HARMFUL ACTS OF ANY ORGANIZER, ATTENDEE, OR THIRD PARTY, INCLUDING VIOLENCE, SEXUAL CRIMES, TRAFFICKING, DRUG ACTIVITY, OR WEAPONS.

Some places do not allow certain limits. In those places, our liability is limited to the maximum the law allows. These limits apply to any theory of liability, including contract, tort (including negligence), warranty, or otherwise, and they survive even if a remedy fails its essential purpose.

11You cover us (indemnity)

You will defend, indemnify, and hold harmless Zbroz Technology Solutions, LLC and its people, contractors, and partners from any claims, damages, losses, and costs (including reasonable legal fees) that arise from: your content; events you host, organize, promote, or attend; crime or harmful acts by you or by others at an event you are connected with; your use of the Service; your breach of these Terms or the law; or your dispute with another user. We may take over the defense at our expense; you will still cooperate.

12Ending the Service

You may stop using the Service and delete your account at any time in Profile (password required). We may suspend or end access, delete content, or stop offering the Service, at any time, for any reason, including violation of these Terms, risk to others, or if we shut the product down.

Sections that should survive still survive, including your content license, event-risk section, no-warranty, limit of liability, indemnity, disputes, and this survival sentence.

13Disputes, arbitration, and class waiver

These Terms are governed by the laws of the United States, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs arbitration.

Informal resolution. Before filing a claim, email privacy@thedeafsocials.com with a short description of the dispute and the email on your account. We will try to resolve it in good faith for 30 days.

Arbitration and class waiver. Except for (i) individual claims in small-claims court, (ii) claims to protect intellectual property or unauthorized use of the Service, or (iii) a valid arbitration opt-out, any dispute will be resolved by binding individual arbitration administered by a reputable U.S. arbitration provider under its consumer rules, not in court, and not as a class, collective, coordinated, or representative action. YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.

Opt-out. You may opt out of arbitration within 30 days of first accepting these Terms by emailing privacy@thedeafsocials.com with the subject “Arbitration opt-out,” your name, and the email on your account. If a court finds the class waiver unenforceable for a claim, that claim must proceed in court, not arbitration. If arbitration does not apply, exclusive venue is the state and federal courts located in the United States, and you and we consent to that venue.

14Other legal terms

These Terms, plus the Privacy Policy, Cookies page, and AI & Data page, are the entire agreement for the Service. They replace prior agreements about the same subject. If a part cannot be enforced, the rest still applies. If we do not enforce a part, we can still enforce it later. You may not assign these Terms; we may. Headings are for reading only. “Including” means “including without limitation.” We are not liable for delays caused by events beyond our reasonable control. There is no partnership, joint venture, or employment between you and us because you use the app.

We may update this page. The “Last updated” date at the top will change. If you keep using The Deaf Socials after an update, you accept the new version. We may also tell you in the app or by email when a change is important. Your continued use is acceptance even if you do not read the new version.
